Just two days ago I met with one of my favorite wholesalers (he even thinks I should name my company after him) to see how we can take our business relationship to another level.   Currently we share marketing costs and he puts deals under contract with us as the buyer.  We get the financing, do the rehab and sell the property.  He ends up with a percentage of the net profit on the deal. This is the method you will use by default if you do not do your contract on the front end correctly, so we do see double closing frequently. With simultaneous and double closings, you don’t use the assignment of contract form as you are not assigning your contract (the agreement you signed to purchase the house from the homeowner seller). Instead, you sign another purchase agreement with your end-buyer with you as the seller. You don’t own the house but do have a vested interest in it and so can sign to sell the house as the new seller (of course, if your closing with the original seller doesn’t happen, you won’t be able to close the second transaction because you will not own the house). Two questions: Yes. But it can become illegal depending on how the wholesalers market in the jurisdiction, if their contract contains 999 escape clauses, or if they violate specific local laws. If I told my boss, “No, I don’t have enough recent server experience”, I wouldn’t be able to have helped them save well over $500k on server hosting costs YEARLY. Not to mention, the ability to do so much more. If you got a grand-slam deal, say, a property with an ARV of $100,000 for $20,000, only needing cosmetic repairs of $10,000, and you sell the contract for a fee of $15,000, even though there is plenty enough spread for the buyer (he’d be getting it for $30,000, plus $10,000 rehab, meaning his profit would be $50K+), he might think you are a chump for trying to make a $15,000 wholesale fee. Get My New Book! Think like a seller: One of the mistakes new wholesalers make is thinking that everyone that needs to sell is going to sell. Many sellers you speak with will be in distressed situations that they wish they could get out of. Even though they know selling is what’s best, they don’t always do it. How you talk to sellers is the single biggest thing that will get you more deals. Instead of pressuring them to sign a contract, you need to listen to their situation. Find out everything about their motivation, how they got there and where they will go after they sell. When meeting a motivated seller, you should listen much more than you talk. Have a script in place, but don’t sound scripted. Ask important questions, but listen to the answers. Your seller may not want to move for six months. They may have unrealistic demands to move out. If you ignore these facts, you will work for months without ever closing. Motivated sellers will work with investors that they trust. When meeting for the first time, don’t think like an investors, think like a seller. That’s a great question. Dealing mostly with vacant land, I haven’t encountered this on many occasions. That being said – I have to think that if the contract gives you control the property, you should almost be given a key (or some kind of lockbox) on the property allowing you to come and go as you please. Off-market properties are not listed for sale, but the owners want to sell. The owners may be too far away, too busy, or too beat down to list the homes with a real estate agent.
