I agree completely with you Rob. If the purchase contract is structured properly, there’s absolutely nothing wrong with an assignment. It is important to properly manage the expectations of everyone involved. We purchase contracts on assignment frequently. The fact here is that you are not selling a property. You are selling a contract. You are marketing a contract to buy discounted real estate, not marketing a property you don’t own. The asset involved in the transaction, whether real estate or a banana, will need to be inspected by the individual or entity that plans to use it as a basis for the value of your contract. If you manage the transaction this way, you will not have these problems. Some title companies will not do simulataneous closings and some will, but will require it be disclosed to the lender (if there is one) for your end-buyer that the funds for the deal will go to pay for the first transaction (not a big deal if end-buyer’s funds are hard money). The best thing to do is find out if the title company you intend to use will allow a simultaneous close and if so, what their requirements are.
