Can a non US citizen living outside the US practice remote real estate investing? Can you advise with respect to the legal framework, taxes and all other considerations required to pursue real estate from this angle as well as any advice especially for me being a newbie? Hey Matt! Yes, I have done this kind of thing in-house before, but honestly, it’s a big logistical challenge (even for a simple deal, with cash, where everyone was in the same county). It requires a bit of “trust” on everyone’s part, which isn’t necessarily the best way to run a real estate closing, and it’s a lot more stress than I like to deal with – so even though it’s possible, I don’t typically recommend this. 11/May/18 - 11:07 pm Klaus Elmfelt on March 8, 2016 11:17 am Investing in Rental Property Commercial Solutions Texas Farm Credit (2) I think it is wonderful that through the constitutional right to the free alienation of property in conjunction with the contract law that states a bi-lateral contract in real estate constitutes equitable interest, that in most cases, a non-licensed real estate agent can effectively broker a deal and legally get paid…but make no mistake…what a wholesaler is doing is brokering a deal. In an assignment, you will simply write (in the spot where you write the buyer’s name) “and/or assigns” after your name. This means that you, and/or someone you assign the contract to, will buy the property. Assignments are typically not allowed when buying foreclosures, but most homeowners will not care. However, it’s important that you are upfront with the seller about your intentions. Next, you’ll need to sign an “assignment contract” with your cash buyer which officially assigns them the contract.  These clubs send out weekly emails with available properties for sale. You have a contract but that means nothing to some people. This is why it is important to let people know NOT to bother the tenant. You don’t have to tell them the tenant is the current owner. Other than that, if they ever want to receive any more deals from you, they will know not to try and go behind your back. August 3, 2016 at 4:21 pm It wasn’t just the experience I had, but also the other things I mentioned, namely that it could easily be seen as illegal (in the way that most wholesalers do it). Be sure your contract includes permission to show the property to prospective buyers. Also, make arrangements with the sellers for a way to show the property. Consider putting the following clause in your contract: "I'm going to have people I work with look at the property. That may include partners, an appraiser, a contractor, or a handyman. We need to have access to the property." This will allow you to show the property to the people you need to make the deal happen. Canadian Real Estate Mentor/trainer/speaker Do you have to be licensed to have either ownership or a contractual position? Does this mean that wholesalers must be licensed? When they ask how much are you making 2M ago55:52 Be Transparent as to your Role in the Deal:  If your intent is to wholesale the property during escrow, the homeowner should be well aware in writing that your intent is to assign the deal to a third party for profit, and the contract language should give you a unilateral right to assign without requiring the consent of the homeowner.  Most standard form purchase agreements you get from realtors do not have this language and so an amendment or specially prepared form may be necessary.   On the buyer’s side, you should be very clear in your written agreement with the end buyer as to what you will be responsible for and what will be the responsibility of the end buyer.  For example, are you going to do an analysis of after repair value (e.g. running comps and estimating repair costs)? Run title?  Do an inspection?  What happens to your earnest money deposit once you assign the contract to the end buyer?   Your agreement should clearly specify in detail what your specific obligations are in the deal, where your obligations in the deal ends, and what the end buyer is expected to do to close the deal.  It is better to have these details on who does what expressed clearly in writing rather than rely on assumption.    Most importantly, you should include language that fully releases you from any further obligations or liabilities in the deal to ALL parties once you complete the assignment to end buyer. In the event you aren’t working directly with a seller, I would venture to guess your main point of contact will be with the respective Realtor. If that’s the case, be sure to collect their contact information as well. In fact, go ahead and collect their information even if you are working with the seller directly, as Realtors will oftentimes be more “in tune” with the situation and offer better information. The Consumer: The real estate wholesaler may be doing the motivated or distressed seller a favor by purchasing his or her property. Several personal scenarios may cue the seller to aggressively sell his house. The seller may be motivated because of a job transfer. Or, the seller may have missed a couple of house payments and needs to sell the house fast before the lender or bank sends him a notice of default. The seller may not be interested in making an optimal profit. Best of luck, 19.) Simply, a single family home is purchased for a low price during a low market, remodeled to force appreciation, and held until the market improves and sold.
