A wholesaler can actually sell the contract to another investor without buying the home. Anyone else can step in and be the buyer as long as they buy the home according to the terms of the contract. The buyer and seller both have the right to change the purchase agreement. So, the buyer and seller could legally cancel the existing contract and create a new one. (Remember, you’re no longer the buyer) You could be sitting at the closing table, and you wouldn’t be able to legally stop it. The title co also wouldn’t be able to stop those changes, as the buyer and the seller have the right to change their agreement. A newly written agreement could take the assignment out of play from the title co perspective. The title co is simply a facilitator for the written agreement in the transaction, even when the buyer and seller make a last-minute change. Even though your buyers are lined up and waiting, and you’ve lined up plenty of capital from private lenders, you still need to find inventory that works. That will typically be some form of distressed property or a property being sold by a motivated seller. Well firstly you are essentially flipping a property without ever closing on it. You are really not flipping the property but flipping the contract which gives you the right to buy the property. This means that you do not have to come up with any cash to buy the property. You also do not need to pay any closing costs or incur any other expense. Wholesalers flip properties for a living and by using the “assignment of contract” they save a lot of money in closing costs and fees and still make money flipping properties. Those fees can really add up. If you flip 10 properties a month and the closing costs for each flip is $1,000 then you would save $10,000 a month by assigning the contract instead.
