HOME 2 | Should offer to sell only the contract, not the property for a designated Assignment Fee price; Respectfully, Danny Johnson on September 26, 2013 at 9:00 am Connecting Buyers & Sellers Without a Middleman Digital List Price: $25.00 The statutory definition of what constitutes “real estate brokerage” is a bit lengthy, but the short answer is that brokering real estate means selling property: (a) that one does not own, (b) for a fee or other thing of value. December 10, 2017 Great insight here. You’ve brought tremendous balance for a newbie such as myself. I was so discouraged reading the article and then many of you who commented gave balance. Grateful for the knowledge and opinions, and even the article, Brett! Real estate wholesaling is not set in stone and it is not a science. A person who is setting out to start a career as a real estate wholesaler will find obtaining reliable information is hard to come by, because there are so many different ideas used by each wholesaler. Which idea can you trust? Real estate has always depended on numbers, profits and potential but wholesaling is a personal craft that is hard to understand completely. A few wholesalers would advise to focus on your network, while others advise to focus on finding the cheapest properties, and your networks will create themselves. Part of the reason for the housing crisis is that people were ignoring certain rules. Banks were giving mortgages to people who didn’t have jobs! They have out $800,000 mortgages to people making working class money. And then acted surprised when it all blew up. I’ve been evaluating a project that has 17 rooms (for rent) on the upper floors and 3 retail spaces on the ground level. All fully rented. The different dynamic from a normal mixed use property with leases is as follows: 1, rent is collected weekly, 2. there is no long eviction process for non-payment of rent. The landlord just locks the door, 3. rents are in cash. The key is having a good super to collect rent and enforce the rules. In this case the super lives in a first floor apartment rent free. Also, commercial banks are normally reluctant to finance such projects for what they consider to be higher risks. As I said, this project is fully rented and throwing off a lot of cash. GOI is roughly $170K per year. GOE is about $37K. Has anyone here had experience in this type of investment? Thanks. 9 Mauricio E. Cultivate productive habits Real estate investment trusts (REIT), Mortgage-Backed Securities (MBS) and Mortgage Investment Corporations (MIC) are generally considered to be vehicles for deriving real estate income. This is true, but only in the sense that real estate is the underlying security for a publicly traded asset. With a REIT, the owner of multiple commercial properties sells shares to investors (usually to fund the purchase of more properties) and then passes on the rental income in the form of a distribution. The REIT is the landlord for the tenants (who pay rent), but the owners of the REIT get the income once the expenses of operating the buildings and the REIT are taken out. Learn more in "How to Assess a REIT.") Scary stuff for any wholesaler! Be Transparent as to your Role in the Deal:  If your intent is to wholesale the property during escrow, the homeowner should be well aware in writing that your intent is to assign the deal to a third party for profit, and the contract language should give you a unilateral right to assign without requiring the consent of the homeowner.  Most standard form purchase agreements you get from realtors do not have this language and so an amendment or specially prepared form may be necessary.   On the buyer’s side, you should be very clear in your written agreement with the end buyer as to what you will be responsible for and what will be the responsibility of the end buyer.  For example, are you going to do an analysis of after repair value (e.g. running comps and estimating repair costs)? Run title?  Do an inspection?  What happens to your earnest money deposit once you assign the contract to the end buyer?   Your agreement should clearly specify in detail what your specific obligations are in the deal, where your obligations in the deal ends, and what the end buyer is expected to do to close the deal.  It is better to have these details on who does what expressed clearly in writing rather than rely on assumption.    Most importantly, you should include language that fully releases you from any further obligations or liabilities in the deal to ALL parties once you complete the assignment to end buyer.
