5. Tax Advantage 4.0 out of 5 starsUnique but Highly Profitable Real Estate Investment Strategy With simultaneous and double closings, you don’t use the assignment of contract form as you are not assigning your contract (the agreement you signed to purchase the house from the homeowner seller). Instead, you sign another purchase agreement with your end-buyer with you as the seller. You don’t own the house but do have a vested interest in it and so can sign to sell the house as the new seller (of course, if your closing with the original seller doesn’t happen, you won’t be able to close the second transaction because you will not own the house). A typical wholesaler might use postcards sent to absentee owners (owners who don’t live in the home) to try to buy the home. Absentee owners are sometimes more motivated because they don’t live in the house and may have bad tenants or no tenants. The wholesaler will negotiate a price with the seller knowing what his buyers will pay. The wholesaler will use a contract that can be assigned and then collect an assignment fee at closing. Real estate agents are usually not involved, but can be. The difference between what the wholesaler agreed to pay the seller and what the investor/end buyer agrees to buy the house for is what the wholesaler makes. Wholesalers may make a couple thousand dollars per deal or much more. I know multiple wholesalers that have made more than $20,000 on one deal. I am solely responsible for how well my business does. I work harder some months than others. I feel enormous pride in growing my business to where it is now, and even bigger excitement at where I am heading. Hi Laura – in my experience, as long as the original Purchase Agreement has an Assignment clause in it (which gives the buyer permission to assign the contract), the only other form you’ll have to complete (with the end buyer) is the Assignment Agreement (which should state whatever fee the wholesaler is being paid). You would then give both documents to the title company so they can handle the closing… but as far as I know, there shouldn’t be any need for a second PA. Dogfish Head 75 Minute IPA: An IPA brewed with maple syrup. I own my own medical office building and have three tenants but my office manager is also the property manager. He is constantly chasing down problems, satisfying regulatory requirements (aka fire safety checks). It’s a lot of work and hassles. The tenants seem to be happy. We managed to secure a 10-year note at 3.95% fixed on the property so low interest rates have helped but there are still taxes and that’s a big drag on performance. Maybe the new tax law will effect “pass through income” for property rentals but I think there are limits on this tax relief. S. If the wholesaler has collected his assignment fee up front, he may not care whether or not the deal closes. However, the wholesaler was the person who sat down with a motivated seller, someone with a problem and presented a solution for them. There may be no legal obligation to help the seller, but there may be a moral or ethical obligation for some people. Renters Should Pay More Taxes (289) Should you offer the $75,000 in this example? I’m glad to hear this was helpful for you! 🙂 > The 90 Day Rule Ask the Community May 16, 2014 at 1:14 pm Before you can wholesale a property, you need to find a good deal. Use whatever method you prefer for finding good deals--and then get that deal under contract. A good wholesale deal must be 25 to 40 percent below retail value. For example, if you find a house that's worth $100,000 and you can purchase it for $93,000, you probably won't profit from the deal. You need to find a deal with a good profit margin so that when you wholesale it to someone else, they profit from it as well. When negotiating with the buyer, use the contractor’s estimate to your advantage. Let the buyer know that you have other buyers interested and if they want to get this great property, time is of the essence. The buyer will need to leave a good faith deposit, which can be made out to the wholesaler, or the title company and held in escrow until the property goes to settlement. On the same coin though – I don’t mean to discourage you, because I know it can work in some cases. If you’re looking at a deal where you think it might make sense, feel free to dive in and see if you can make the deal happen! Please see Mr. Maloney’s response to Paul Huenefeld below who asked the same question. The inspection period on a wholesale is a little different than the specific home inspection conducted on a conventional sale by a home inspector (and paid for by the buyer). The term, inspection, is used more broadly here to encompass all the due diligence including you, the wholesaler, finally getting inside to look at (inspect) the exact condition of the property. Of course, if you want a professional to make an itemized list of the property’s condition, features and demerits, you should expect to pay for it. After repaired value (ARV), finding the value of the property after the repairs and upgrades is the number one step in the deal evaluation process. Calculate the amount that people are ready to pay and then determine the other expenses, together with this find out the most advantageous place to initiate in order to make a decent profit. You could have them agree to the new price, change it on the original contract with them and have them initial the change. -Jim DeFrayne Brandon Turner on September 3, 2012 9:49 pm 2 thoughts on “IS WHOLESALING REAL ESTATE LEGAL?” Financial Freedom Fridays How To Use The Wholesale Real Estate Forms... The double close is similar to the simultaneous close but differs in that your end-buyer’s funds are not being used to close the A transaction. You need to fund the purchase (A) transaction and then sell the house to your end buyer. There are such a thing as bridge loans that are for this purpose. For a fee, a lender will lend money for the A transaction and be paid back on the B transaction. You could try to get one of the bridge loans or just use your own money or get a hard money loan or private money loan. All of these add a lot of cost to the deal, so you need to make sure there is a lot of room (good-sized wholesale fee) to cover the costs and still allow you a profit. It’s a math problem. Math doesn’t care about experience. If the deal is good for an investor he/she won’t care if it was delivered by a professional circus clown, unless said investor fits into the “box of rocks” category you mentioned. If the property is owned by an individual (not a bank) then an assignment of contract can be a really low cost entry into wholesaling. And this is especially so for new investors and beginning wholesalers. All you need to get started is your states standard Purchase and Sales Contract, $10 and a seller that is willing to sign a contract to sell their property. There are many components to be aware of. The Service LinkedIn In general, wholesaling is dependent on the ignorance of the original owner (don’t know the property market value) or the ignorance of the investor (don’t know the property market value, repair cost or arv). The wholesaler exploits this ignorance. In other words, the wholesaler takes advantage of the original owner or investor.
