U.S. In that case, the 10th Circuit was reviewing the question of whether a real estate purchaser was able to take a demolition loss on his tax return. The answer to the question came down to the moment the property was purchased. There were two competing ideas of when the real estate was purchased. The first date considered was the date the Contract for Sale of Real Estate was entered. The second date considered was the date the purchaser received the warranty deed and took possession of the real estate. The 10th Circuit stated, “The commonly accepted definition of “purchased” is a binding agreement to pay an agreed price. It may be a complete or an incomplete transaction in terms of tender, but it must be binding and enforceable.”[iv] Ultimately the 10th Circuit determined that the real estate was purchased on the date the contract was signed. Once you find the right property and get it under contract, it is time to find a buyer. If you’ve invested in real estate before, you probably already have a solid buyers list. If not, you can find a buyer using the same techniques you employed to find your property. I never got one response. Then I got my first deal under contract about a month ago. At first I figured the ARV too low, and I got no calls or responses of any kind from any of my property ads. I went back to the seller and renegotiated a lower price and then put the property back out there. Suddenly, my phone started going crazy. Just in the last week, I have had 6 investors come through and look at the place. I have had 2 other wholesalers offer to JV with me in the same time frame. I have three more appointments to show the place this week. I am fairly certain that a buyer will snatch this up before the end of this month, based on what I’ve been experiencing.
