Assigning a contract is perfectly legal. However, what people are doing to get from contract to assignment is frequently not. Driving to the Beach is legal. Driving 90 miles an hour to get there is not. Assigning a contract simply takes a few sentences to accomplish. Of course, a specific contract can prohibit assignment, but the law clearly allows it. The Inability To Find A Buyer: The key to being a successful wholesaler is having a solid buyers list. In the world of wholesaling, no buyer means no deal. Additionally, your personal risk is contingent on the way your contract is written. So depending on how much you put down in escrow – which, again, could have been as low as $10 – you might have to repay your seller if you are unable to find a buyer. It is best to have potential buyers lined up before even making an offer to the seller. That way, your risk of losing money is substantially lessened. While owing your seller a measly $10 doesn’t sound like a lot, it has a bigger affect on your reputation. If word gets out that you are negatively affecting homeowners, future buyers will be less likely to want to do business with you. Of the millions of homeowners out there, a very small portion of them at anyone time want to sell their homes. Then, of these sellers, an even smaller percentage of them (our studies show less than 5%) are so incredibly driven to sell their property that they are willing to give it away for a very cheap price (or very favorable terms). Commonly referred to as “motivated sellers”, it is from these people that most wholesale deals are created. In many cases, motivated sellers are in a tight spot and they have very few options left in selling their house. When a person is backed into a corner, they usually become emotional and sometimes irrational. So the emotions and irrationality of these people is both and good and bad to a real estate investor. On the one hand, the fact that circumstances in their lives have created this situation provides wholesalers with the opportunity to get a good deal. On the other hand, those emotions and irrationality creates a volatility that can be like gun powder and one spark can set them off. However, why not start looking for buyers as you are marketing and getting started? It will take some time before you will find a good wholesale deal (usually). This way you can find the buyers that are the most serious and that you feel you want to build a business relationship with. You see, most investors that are wholesaling houses have a handful of buyers that buy 90-95% of their deals. I feel it is better to start finding this group of VIP buyers as soon as possible.
