I purchased a property from a wholesaler I am guessing. It was part of an estate sale. We agreed on a price of 125,000 cash. I gave him a 5,000 EMD check. I am about to settle on the property and on the settlement documents I see a $5,000.00 charge called an “Assignment Fee” I was unaware of any additional charges such as this… I am already in the deal for $5,000.00 and will lose the EMD if I pull out. Is his a normal practice to slip in a charge like this?

Mark is not the only wholesaler that I know making that kind of money. I know wholesalers in Texas, California, new Jersey (especially Piscataway homes) and Ohio doing just as good or better. I am not seeking out wholesalers, these are people I meet through my blog or other investors. If you are willing to work hard and put a system in place you make an awesome living as a wholesaler.

If you can’t find a buyer, there are a couple options available to you. You could lower your wholesale fee and ask for less for the deal. You could renegotiate the deal from the seller to get the price down. Or, you could simply back out of the deal, if you put an escape clause (statement like, “This agreement is subject to agreement by my partner.”) in the agreement. This is the worst option and I hope you never have to do it. Even if you don’t make any money on the deal but can find a buyer to pay what you had agreed to pay the seller, get the deal done. You gave your word to the seller and you need to honor it.

One disadvantage to the assignment of contract method is that your buyer will see how much profit you make based on your assignment fee. So if your profit is a large amount it could potentially create a problem with your buyer trying to reduce the purchase price after he or she has agreed to purchase the property. For example if you purchased the property for $15,000 and tried to sell it for $45,000 with a $30,000 assignment fee then you might encounter a lot of resistance from the buyer who thinks you are marking up the property excessively. This could be avoided by using the double closing method where the buyer does not see how much you paid until after the transaction has closed (public records).

The deals that I have found have been so freeking good that I kept them for my self. Having said that I am open to wholesaling and i am confident that I will wholesale some deals in the near future. The thing is though, is if you enter into a purchase agreement without the intent to purchase, even if you have disclosures saying your intent is to assign the contract, there is a case to say you never had a valid contract to begin with.

By the time I got to this point with one of my properties, it had become clear that if I could do it all over again, I wouldn’t have sunk my own money into this property. It would have been far better for me to simply assign the Purchase Agreement (if I even could) rather than buying it outright. As you can imagine, if there’s ever something wrong with a property – it’s better for this problem to be in the Seller’s lap than mine.
Now the wholesaler has two ways to approach the contract with the seller. Let’s assume that the home can be purchased for $112,000 with a current retail market value of $156,000. Giving the buyer a 10% discount from list. That would be a selling price of $140,400.
